Representing clients during litigation, arbitral proceedings and out-of-court negotiations. We analyse the facts and principal legal issues of the case, plan procedural tactics and propose solutions for the case, including the possibility of a peaceful settlement. Legal services related to enforcement and distraint proceedings.
Drafting of management and employment agreements, agreements on work performed outside of employment, and internal rules of employers. We provide help in relation to termination of employment, cancellation of offices, large-scale layoffs and eventual labour law litigation. Magdalena Grznárová (born Krakovičová) graduated from Law Faculty of Masaryk University in Brno. During her studies she participated in an educational stay at Mykolas Romeris University in Vilnius (Lithuania).
During her practice she gained experience and knowledge in large Czech and foreign law offices. Since 2014 she has been practicing law as an independent attorney. Magdalena speaks English and French and she provides legal services in all areas of law, especially in the following: tax law, commercial law, law of obligations, litigation and arbitration.
In addition, Magdalena specialises in setting up internal structures, negotiating of international contracts, management liability and corporate governance.
Liběna Šrámková (born Vondráčková) graduated from Law Faculty of Charles University in Prague and from Physical Education and Sport Faculty of Charles University in Prague. During her studies she participated in an educational stay at Eberhard Karls Universität Tübingen (Germany). Between years 2008-2009 she completed post gradual studies at Justus-Liebig-Universität Gießen (Germany), where she was awarded Master of Laws (LL.M.) degree.
Between 2009 and 2011 she has gained experience in the law office of Bubník Myslil & Partners as a legal trainee and since 2012 as an independent attorney, especially in areas of real estate law, sports law and arbitration. Liběna speaks German and English. Liběna provides legal services in all areas of law, especially in the following: sports law, real estate law, commercial law, law of obligations, litigation and arbitration.
Fee for provision of legal services is agreed between attorney and client and may take the following forms:
determined by number of legal acts with a fixed amount for one legal act. Specification of legal acts is to be found in Sec. 11 of the Ministry of Justice Decree No. 177/1996 Coll., on Fees and Remuneration of Attorneys for Provision of Legal Services (the Attorney’s Tariff). Examples of legal acts specified in Sec. 11 of Attorney’s Tariff are: acceptance of and preparation for representation or defence, a written submission or a petition in relation to the merits, attending trial before a court.
determined as multiple of hourly rate and number of hours necessary for provision of certain legal services.
determined by fixed fee for the case. Flat fee is offered for the clients who require provision of legal services on a long-term basis. Flat fee is usually paid monthly, which enables clients to predict the amount of this cost in their budgets.
Apart from fees, clients are also charged for the compensation of cash expenditures spent in relation to the provision of legal services, in particular paying court and other fees, travel costs, expert opinions and translations. While determining the amount of the fee, the attorney must take into consideration not only the criteria of how time-consuming and onerous the case is but also the financial possibilities of the client. The client is informed about the anticipated extent of work and total costs for the provision of legal services before the commencement of legal services.
Non-contractual fee is determined by the Ministry of Justice Decree No. 177/1996 Coll., on Fees and Remuneration of Attorneys for Provision of Legal Services (the Attorney’s Tariff).
